Signatures on Contracts

Contracts are signed everyday.  What 'seals the deal' on contracts is still a person's signature.  In this generation, signatures are still created with pen in hand.  Quit Claim Deeds are still signed and notarized.  Last Wills and Testaments are still signed and notarized.  Car dealerships still have an individual sign.  Real Estate deals still have an individual sign.  A person's signature is still one of the most important things we maintain that speaks to our individuality.  One guard against forgery or the simulation of a person's signature is to craft a signature that is complex enough that it becomes difficult to simulate.  It is very important that when a signature goes on a contract that it is individualized and complicated.  Everyone has their own skill level in writing.  A person can write below their skill level but they cannot write above their skill level.  If you would like to craft a signature that becomes harder for someone to simulate, contact me.

Is Forgery the Perfect Crime?

Sometimes it seems that forgery is forgotten as a crime.  Don't get me wrong, it is still a crime.  But because it very seldom means physical harm to another person, not very many spend jail time for the crime.  It seems the punishment when an action is pursued in court, is that the person attempting the forgery just doesn't get rewarded with the financial prosperity they are hoping to achieve.

The root cause of forgery is a five letter word that has been with humans since the race began:  greed.  Greed causes an individual to make a decision that they deserve something and that the person they are taking from doesn't.

Forgery seems a simple undertaking by the perpetrator.  But the effects forgery cause can be disastrous to an individual or a family.  If you are facing a situation today that has left you hurt, angry and confused by someone attempting to steal by forgery what belongs to you, contact me.

Here We Go Again

January 2018 has started with great anticipation and speed. January seems to be recognized as a New Beginning.  What seems to come into the New Year is the good and bad actions of people.  As a Forensic Document Examiner, those actions usually increase my business because someone usually lets their greed show.  There were words to a song made popular many years ago that said, "Using things and loving people that's the way it's got to be".  It would be wonderful if that was a true description.  Many times what is seen instead is loving things and using people.  If you have found yourself in a situation of fraud and are in shock, contact me.  If you need handwriting compared, contact me.  I never charge for a consultation.

Greed and Self-Serving

During this last year, I have examined several Wills and Trusts.  When forgery is involved, those Wills and Trusts involve cutting out several people and giving the bulk of what is to be inherited to primarily one person.  Because of the years as a document examiner, this always looks suspicious.  When someone contacts me and says, "I noticed the signatures just don't look right", they are usually correct.  I can truly say that greed and being self-serving is very much alive and well.  It is difficult to evaluate intent until someone makes that intent known by taking legal documents, changing the wording to eliminate primarily everyone but themselves, and craftily signing or tracing another person's name.  But, then, we get into a whole new legal definition of the word intent.

The loss of a loved one is usually a very difficult time.  There are those who are mourning and then find themselves shocked when the Will is produced and read.  Greed and being self-serving doesn't just exhibit in those who are wealthy, it can be observed even in those who have little of this world's material goods.  There will always be those who feel that they deserve something more than others do.  If this has happened to you, contact me.  I can help with the examination of the signatures and the documents.

Cost of the Fight

In the last few months I have seen some odd happenings and rulings in court and attorneys who gave clients information.  I have seen fair rulings by judges for sure but one judge openly said that he believed my report and that the documents were forged but he ruled in favor of the other side.  The other side was bank and mortgage companies.

Someone recently used my services and were advised by one attorney that attorneys can be believed and not to be doubted and then a different attorney told them that on Wills and Trusts if a person gave someone permission to sign their individual name (even if the person wasn't their official Power of Attorney) then it was legal and that even if the name was not written correctly, that could be an understandable mistake.  I was shocked at both instances.  Since when is forgery an acceptable route and not punishable or a person who perpetrates a forgery is seen as just 'smarter than the ones they got the best of'?

This type of information causes me to shake my head but it doesn't cause me to want to give up.  There are still judges that will render fair judgements.  There are still attorneys who will fight for their clients even if it is an uphill battle.  In conclusion, the important thing in making a decision on what the next action should be is this:  am I willing to put forth a fight even if I lose the battle?  We all want to win our battles, but, unfortunately some battles are lost.  The cost of the fight must always be evaluated.  What a person is willing to lose must be part of the decision.  My heartfelt desire is that wisdom be a guiding light in the decisions made.  ExpertHandwritingExaminer.com
