Greed and Self-Serving
During this last year, I have examined several Wills and Trusts. When forgery is involved, those Wills and Trusts involve cutting out several people and giving the bulk of what is to be inherited to primarily one person. Because of the years as a document examiner, this always looks suspicious. When someone contacts me and says, "I noticed the signatures just don't look right", they are usually correct. I can truly say that greed and being self-serving is very much alive and well. It is difficult to evaluate intent until someone makes that intent known by taking legal documents, changing the wording to eliminate primarily everyone but themselves, and craftily signing or tracing another person's name. But, then, we get into a whole new legal definition of the word intent.
The loss of a loved one is usually a very difficult time. There are those who are mourning and then find themselves shocked when the Will is produced and read. Greed and being self-serving doesn't just exhibit in those who are wealthy, it can be observed even in those who have little of this world's material goods. Cost of the Fight
In the last few months I have seen some odd happenings and rulings in court and attorneys who gave clients information. I have seen fair rulings by judges for sure but one judge openly said that he believed my report and that the documents were forged but he ruled in favor of the other side. The other side was bank and mortgage companies.
Someone recently used my services and were advised by one attorney that attorneys can be believed and not to be doubted and then a different attorney told them that on Wills and Trusts if a person gave someone permission to sign their individual name (even if the person wasn't their official Power of Attorney) then it was legal and that even if the name was not written correctly, that could be an understandable mistake. I was shocked at both instances. Since when is forgery an acceptable route and not punishable or a person who perpetrates a forgery is seen as just 'smarter than the ones they got the best of'?
This type of information causes me to shake my head but it doesn't cause me to want to give up. There are still judges that will render fair judgements. There are still attorneys who will fight for their clients even if it is an uphill battle. In conclusion, the important thing in making a decision on what the next action should be is this: am I willing to put forth a fight even if I lose the battle? We all want to win our battles, but, unfortunately some battles are lost. The cost of the fight must always be evaluated. What a person is willing to lose must be part of the decision. Skill Level
Every person who writes has their own skill level. Skill level represents one's ability to construct letter, character and number forms, the size and shape of letter, character and number forms and how one places them on the writing surface. The wonderful thing about skill level is that no one can write above their own skill level. They can write below their skill level but never above. This is one of the considerations always made when handwriting is being compared. Someone with a high skill level may write below that skill level in order to 'throw off the scent' (one might say) for the person who is comparing the writing. But when writing is being compared by a forensic document examiner and that writer has a higher skill level than the person who was supposed to have been the writer, it is readily known that person could not be the writer. Likewise, when a person is on drugs (street or prescription) that affect the brain or that person is in a drunken state, it becomes impossible for them to write at a higher skill level than they do when sober. Is There Proof That Handwriting Is Individual?

N. Srihari is a computer scientist and educator who has made progress with
pattern recognition and developed software known as Cedar-Fox (granted a U.S.
Patent in 2009) used by the US Postal Office primarily for handwritten address
systems. Srihari’s work on the
individuality of handwriting has been cited in Daubert and Frye standard
hearings in the United States and cleared the way for admitting handwriting
evidence into the court system.
Handwriting experts through looking and examining hundreds and thousands of samples of handwriting and through training know that there are defined differences in individual's handwriting. Some differences are not noticed by untrained eyes but trained eyes notice things that others would by-pass. Also it is known that there are individuals who have 'form blindness' and cannot observe differences in writing. In training to be a handwriting expert, one of the first 'tests' given is to discover if that person has 'form blindness'. Unfortunately, 'form blindness' tests are not given in the courtroom to judges, attorneys and jurors and it is up to the handwriting expert to present a well-defined report with exhibits in order to substantiate their opinion to the court.
The Fathers of Document Examination have long held to the opinion that handwriting is individualized and now through the use of computer software their opinion is being validated. Another area that is validating individuality are the use of brain scans using MRI's. These brain scans now illustrate how the brain, muscles and nerves function together just as handwriting experts have always explained that they do.

I Don't Know You
It is really amazing what a person's cursive writing can tell me. Even if I have never met you, if I look at your handwriting, I will know something about you. One's handwriting can show intelligence, forthrightness, honesty, bullying, sarcasm, and much, much more. There is even a high probability that I can give accurate information on the gender of a child by examining certain letters in an expectant mother's writing. What Is Brain writing?
Brain writing is when the subconscious has something to do with what is being written. We can control our conscious actions in our writing, such as when we print. But, it has been illustrated time and again that when we write in cursive we can't control what the brain inserts into the writing. The next time you sign your name or write something in cursive, take a few minutes and look at it. Does it have skips in the writing? Does it have dots in the writing? These are things you didn't do on your own. These are things that the brain has a part in doing. This is part of the reason that a person's writing becomes individualistic. When a person's muscles, nerves and brain combine together they become a force to be reckoned with and individual handwriting occurs.

His software program can identify several aspects of writing and correspond it to individuals. While the software program is great, it hasn't reached a point yet of having the human approach to establishing genuineness to a writing or signature.
